Terms of Service
1. Acceptance of Terms
These Terms of Service ("Terms") are entered into between Worksitepass, a corporation organized under the laws of the Province of Quebec, Canada, registered in French as Permit de Chantier ("WorkSitePass", "we", "our", or "us"), and the person or organization using the Service.
By accessing or using WorkSitePass ("Service"), you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including individual workers, contractors, and company administrators.
2. Description of Service
WorkSitePass is a digital wallet and compliance management platform designed for skilled trades professionals and construction companies in Canada and the United States. The Service allows users to:
- Upload and store digital copies of certificates, licenses, and compliance documents in a worker's mobile wallet
- Track expiration dates and receive automated renewal reminders by email and push notification
- Manage workers' credentials and Company Documents, and generate Compliance Packages (for company accounts)
- Submit select certificates for manual verification by the WorkSitePass team (Certificate Validation)
- Create job sites, define Site Requirements (certificates and Forms, including one-time and daily forms with signature fields), assign workers, and track Site Readiness (Sites)
- Record a worker's arrival at an active site for the current day, once the worker's Site Requirements are complete (Site Check-In)
- Verify a worker on-site by scanning their personal QR code, which opens a public, read-only verification page (QR Check-in)
WorkSitePass's role. WorkSitePass stores and organizes certification records, and may verify documents manually where indicated (Certificate Validation). Customers remain responsible for ensuring their workers meet all applicable legal and contractual requirements. WorkSitePass assists with compliance but does not guarantee regulatory compliance and does not replace professional safety oversight.
3. Account Registration
To use the Service, you must create an account and provide accurate, complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
- Ensuring all information you provide is accurate and up-to-date
4. Subscription and Billing
WorkSitePass offers subscription plans (Starter, Growth, and Business) with different active-site and admin-seat allocations; all plans include unlimited workers. By subscribing to a paid plan:
- You authorize us to charge your payment method on a recurring basis (monthly or annually)
- Subscriptions automatically renew unless cancelled before the renewal date
- You may cancel your subscription at any time through your account settings; cancellation stops future renewals and your access continues until the end of the current billing period
- Fees already paid are non-refundable, and no refunds or credits are provided for partial billing periods, except where required by applicable law
- We reserve the right to change pricing with 30 days notice
Plan limits. Each plan includes a set number of Active Sites and admin seats. A site counts toward your Active Site limit while its status is Active; marking a site Completed or archiving it frees the slot. You can upgrade or downgrade your plan at any time through the billing portal in your account settings.
Free trial. A 14-day free trial is available for new company accounts, with no credit card required at signup. You will not be charged during the trial. If you have not added a payment method by the end of the 14-day trial, your subscription is cancelled automatically and access to the Service — including the admin dashboard and mobile app access for your workers — ends. If a payment method is on file at the end of the trial, your paid subscription begins and your payment method is charged. You may cancel at any time during the trial at no charge.
5. User Content
You retain ownership of all documents, certificates, and other content you upload to WorkSitePass ("User Content"). By uploading User Content, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service.
For accounts connected to a company: workers own the certificates and documents they upload to their own wallet; the company owns its Company Documents, site configurations, and Site Requirements. As part of providing the Service, company administrators can view the certificate status, uploaded documents, and form submissions of workers connected to their company, and form submissions (including any signature fields) and Site Check-In records are retained as compliance records for the company.
You represent and warrant that:
- You have the right to upload and share all User Content
- Your User Content does not violate any third-party rights
- All certificates and documents you upload are authentic and unaltered
6. Acceptable Use
You agree not to use the Service to:
- Upload fraudulent, forged, or falsified documents
- Misrepresent your qualifications or compliance status
- Violate any applicable laws or regulations
- Interfere with or disrupt the Service or its infrastructure
- Attempt to gain unauthorized access to other accounts or systems
- Use the Service for any illegal or unauthorized purpose
7. Intellectual Property
The WorkSitePass platform, including its design, features, and underlying technology, is owned by WorkSitePass and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written consent.
8. Disclaimers
Certificate Validation: WorkSitePass offers a Certificate Validation service for select certificate types. When enabled, our team manually reviews the submitted document against issuing body records and assigns a status of Verified, Rejected, or Unable to Verify. This validation is performed on a best-effort basis and does not constitute a legal or regulatory certification. Validated status reflects our review at a point in time and may not account for subsequent changes to the certificate or issuing authority records. WorkSitePass is not liable for any loss, harm, or regulatory penalty arising from reliance on a Verified, Rejected, or Unable to Verify status.
Other certificates uploaded to the Service are stored as-is and are not reviewed by WorkSitePass. We do not:
- Guarantee that using the Service will make you compliant with any regulations
- Provide legal, safety, or professional compliance advice
- Replace official verification processes required by employers or regulatory bodies
Sites Feature: The Sites feature is a compliance management tool that allows company administrators to create job sites, define requirements, assign workers, and view readiness status. A worker's "Ready" status within WorkSitePass reflects only that the worker has submitted the documents and completed the forms required by the company administrator for that site. It does not constitute:
- A guarantee that the worker is legally authorized to perform work on the site
- A certification that the worker is competent, trained, or fit for duty
- A representation that the site requirements configured by the administrator are sufficient, complete, or compliant with any applicable law, regulation, or safety standard
- An endorsement or approval by any regulatory authority
Company administrators are solely responsible for determining what requirements are appropriate for each job site and for ensuring those requirements meet all applicable legal, regulatory, and occupational health and safety obligations. WorkSitePass does not provide safety consulting or regulatory compliance advice and is not responsible for any workplace incident, injury, regulatory violation, fine, or other loss arising from a worker's site readiness status or the configuration of site requirements within the platform.
Site Check-In: Site Check-In records that a worker tapped the Check In button in the mobile app for an active site on a given day, after completing the Site Requirements configured by the company administrator. A check-in applies to a single day in the site's configured timezone and there is no check-out. A check-in record is not a time-and-attendance, payroll, or hours-of-work record, and it does not verify or represent the worker's physical presence at the site — no location data is collected as part of a check-in. Companies remain responsible for their own attendance, access-control, and record-keeping obligations.
QR Check-in: Scanning a worker's QR code opens a read-only verification page that reflects the worker's profile, certificate statuses, Site Readiness, and same-day Site Check-In status as recorded in WorkSitePass at the time of the scan. The verification page is not an identity document and does not constitute legal proof of a worker's identity, qualifications, or authorization to work. Viewers remain responsible for confirming the identity of the person presenting the QR code and for meeting their own verification obligations.
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. WorkSitePass does not warrant that the Service will be uninterrupted, error-free, secure, or that any stored content will not be lost or corrupted. You are solely responsible for ensuring your actual compliance with all applicable laws, regulations, and workplace requirements, including federal, provincial, state, and municipal occupational health and safety standards (such as Canadian OHS codes and U.S. OSHA regulations).
9. Limitation of Liability
To the maximum extent permitted by law, WorkSitePass and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including but not limited to loss of profits, revenue, data, goodwill, business opportunities, workplace incidents, regulatory fines, or site-access denials — arising from or related to your use of the Service, whether based in contract, tort (including negligence), strict liability, or any other legal theory, and whether or not WorkSitePass was advised of the possibility of such damages.
Cap on damages. Our total aggregate liability for any and all claims arising from these Terms or the Service shall not exceed the greater of (a) the amount you actually paid us in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred Canadian dollars (CAD $100).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the smallest extent permitted by applicable law.
10. Termination
We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to other users, third parties, or the Service. Upon termination:
- Your right to access the Service will immediately cease
- You may request a copy of your data within 30 days of termination
- We may delete your account and User Content after a reasonable retention period
When a company's subscription ends — whether cancelled by the company, terminated by us, or cancelled automatically at the end of an unconverted trial — access to the Service is revoked for that company's administrators and for workers connected to the company through the mobile app.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Quebec, Canada, and you consent to the exclusive jurisdiction and venue of those courts.
Users outside Canada. Users accessing the Services from outside Canada — including from the United States — do so on their own initiative and are responsible for compliance with their local laws, including U.S. federal and state laws where applicable. These Terms apply regardless of the user's location, and WorkSitePass makes no representation that the Service is appropriate or available in any particular jurisdiction.
13. Trademarks & Affiliations Disclaimer
All product names, logos, symbols, and brands are property of their respective owners. All company, product, and service names used on this website are for identification and informational purposes only. Use of these names, logos, and brands does not imply endorsement, sponsorship, or official affiliation with WorkSitePass.
WorkSitePass is an independent digital wallet service designed to help workers and companies organize and manage their professional credentials across North America. The certificate programs and issuing authorities referenced within the Service — including but not limited to Red Seal, CSTS 2020, WorkSafeBC, ASP Construction, Skilled Trades Ontario, COR® Certificate of Recognition, IHSA, St. John Ambulance, WHMIS 2015, OSHA (Occupational Safety and Health Administration), NCCER (National Center for Construction Education & Research), the American Red Cross, and the American Heart Association — are issued and governed by their respective regulatory authorities, training providers, and trademark owners.
Certifications and training programs referenced above are recognized within their respective Canadian province(s) or U.S. jurisdiction(s). Inclusion does not imply endorsement of this website by any issuing authority.
